Privacy Policy
Kinney Agency, Inc. and its affiliated companies, including Peoples Kinney Insurance Services, LLC appreciate the trust our customers place in us when you ask us to help protect your assets.  In order to process insurance and other transactions, it is necessary for us to collect nonpublic personal information about you and share that information with the insurance companies that we represent, other brokers or managing general agents with whom we seek to place your insurance, handle your claims, or provide other services as requested by you.  We do not sell information about you to others.
Title V of the Gramm-Leach-Bliley Act (GLBA) generally prohibits us from sharing nonpublic personal information about you with a non-affiliated third party unless we provide you with a notice of our privacy policy and practices.  We are providing you with this document, to notify you of the privacy practices and policies of Kinney Agency, Inc., and Peoples Kinney Insurance Services, LLC.
Our Privacy Policies and Practices.
Information that we collect.  We collect only the customer information that is necessary to deliver responsive products to handle your insurance needs, provide quality customer service, develop and offer new products and services for our customers or potential customers, and fulfill legal and regulatory requirements.  The information collected will vary based upon the particular product or service you are seeking.  This includes information that we collect from the following sources:
- Information that we receive from you on applications or other forms, such as your name, address, social security number, etc.
- Information about your transactions with us, and our affiliate, such as products or services purchased, the company with which insurance was placed, claims information and payment history.
- Information we receive from a third party, such as motor vehicle records, or information from a consumer-reporting agency.
- Medical information in connection with certain products, or claims.
- Information that we receive from the insurance companies that we represent.
Information that we disclose to third parties.  We disclose nonpublic personal financial information as described above about our customers and former customers as permitted by law.  We disclose information we collect as described above, about our customers or former customers to allow our companies to underwrite your policy (or policies), process and handle claims, ensure proper billing, and to generally service your account.
We will not use or share personally identifiable medical information for any purpose other than the underwriting or servicing of your policy, the processing of a claim, a specific business exception provided in the law, or as otherwise disclosed to you when the information is collected.  We do not share medical information for marketing purposes.
Nonaffiliated third parties to whom disclosures may be made.  We disclose nonpublic personal information about you only to non-affiliated third parties as permitted by law.  Non-affiliated third parties with whom we may disclose nonpublic personal information about our customers and former customers are generally financial institutions with which we have joint marketing agreements.  This includes:
- Insurance companies that we represent, and other insurance providers, such as an insurance broker or managing general agency.
- Self-Insured Groups, if you direct us to seek placement in a Self-Insured Group.
- Other fulfillment service providers such as an envelope stuffing service
We may also exchange information with reputable consumer reporting agencies in connection with your transactions with us.
In some instances, we may be required by law or regulation to disclose information to third parties in response to a subpoena, to prevent fraud and to comply with the rules of, or inquiries from industry regulators.  This may include, but is not limited to:
- A government agency, self regulatory organization, or other organization pursuant to an examination of our records and/or practices.
- Persons to whom a court requires us, by order or subpoena, to provide information.
- An insurance support organization or another insurer to prevent or prosecute fraud or to properly underwrite a risk or to prevent criminal activity.
- Insurance rate advisory organizations.
- Consumer reporting agencies.
Our practices regarding information confidentiality and security.  We restrict access to nonpublic personal information about you only to those employees who need to know that information in order to provide products or services to you.  We maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard your nonpublic personal information.
Our policy regarding dispute resolution.  Any controversy or claim arising out of or relating to our privacy policy, or the breach thereof, shall be settled by arbitration in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
Reservation of the right to disclose information in unforeseen circumstances.  In connection with the potential sale or transfer of its interests, Kinney Agency, Inc. and its affiliates reserves the right to sell or transfer your information (including but not limited to your address, name, age, sex, zip code, state and country of residency and other information that you provide through other communications) to a third party entity that (1) concentrates its business in a similar practice or service: (2) agrees to be Kinney Agency, Inc.’s successor in interest with regard to the maintenance and protection of the information collected; and (3) agrees to the obligations of this privacy statement.
